DUI (Driving Under the Influence)
In Kentucky, if you refuse to take a breathalyzer test, your license will be automatically suspended for at least thirty (30) days. If you are injured at the time of arrest and are taken to the hospital, if DUI is suspected, you may be required to provide a blood sample for testing. When a driver has taken a blood, breath, or urine test, the Commonwealth may attempt to introduce the result at trial.
Drivers in Kentucky can be charged with five (5) different DUI violations. They are:
- operating, or in physical control of, a motor vehicle while under the influence of alcohol;
- operating, or in physical control of, a motor vehicle with a prohibited alcohol concentration;
- operating, or in physical control of, a motor vehicle while under the influence of any other substance which impairs driving ability;
- operating, or in physical control of, a motor vehicle while under the influence of a combination of alcohol any substance impairing driving ability; and
- if under 21 years of age and operating or in physical control of a motor vehicle with a prohibited alcohol concentration.
Even if you are operating, or in physical control of, a motor vehicle on private property in Kentucky, you can still be charged with DUI.
