Billing and Fee Structure

Personal injury lawyers typically work on a contingent-fee basis under which the client may be responsible for costs but pays attorney's fees only if he or she obtains a favorable settlement or verdict. In a typical contingent fee arrangement, attorney's fees, sometimes called legal fees, are calculated as a percentage of the recovery.

Criminal, family and other types of cases are generally handled on an hourly basis. A client may be asked to provide a retainer. A retainer is a type of down payment to cover the attorney's time and work on a case. The attorney will keep track of his or her time and charge the client an hourly rate. As the retainer is earned, the client may be asked to provide an additional retainer. Any unearned retainer will be returned to the client at the conclusion of his or her case.  

Although it may be tempting to choose a lawyer based on who will take the lowest percentage, lowest retainer, or charges the lowest hourly rate, fees alone should not be the determining factor.
